Certified Nutritional Practitioner (CN-P) Agreement

This Agreement ("Agreement") is entered into by and between Kale Health CN-P Program ("KH") and the Enrollee ("Student") upon the Student's acceptance into the CN-P Program. By participating in the CN-P Program, the Student agrees to the following terms and conditions:

1. Definitions:

  • "Student" refers to the individual enrolled in the CN-P Program.
  • "CN-P Program" refers to the Certified Nutritional Practitioner program offered by KH.
  • "Credential" refers to the certification obtained upon successful completion of the program.
  • "Kale Health Professional" or "KH" refers to the organization offering the CN-P Program.

2. Program Structure:

Phase 1: Didactic Education

  • Duration: 3-month didactic phase (self-paced, so you can take longer if needed)
  • Activities: Studying and completing required materials.
  • Credential: CN-P(S), Eligible for Kale Health Professional Certified Nutritional Practitioner (CN-P) upon successful completion of all phases of the program.

Phase 2: Mock Residency (Included at no additional cost with the purchase of Didactic Education)

  • Duration: 6-month mock residency.
  • Structure: 2 case studies per month + mentorship intensive (office hours, mentorship calls)
    • Monthly Credit to submit 1 outside case per month for oversight (bring your own case)
    • Note: credits do not roll over – you have 6 months to use the included oversight.
    • Additional Oversight: Post-graduation oversight available at $399/hour (optional)
  • Labs: All labs to be ordered through KH (Evexia) unless a licensed provider waiver is signed.
  • Clients are NOT provided by KH, and you are not a KH employee or contractor.
  • Support: Access to the medical team for questions and peer encouragement via office hours and mentorship sessions.
  • Culmination: Review of 12 case studies, final exam, and thesis paper.
  • Credential: upon completion of all of the above.

Phase 3: Mentorship (Included at no additional cost with the purchase of Didactic Education)

  • Access: Ability to ask questions to the medical team related to content within CN-P and interact with the cohort community. Individual review for any clients you might have is notĀ 
    included. Each student will not have an individual mentor, and there will be no regular mentorship calls. The mentorship period is only for questions and additional resourcing.
  • Oversight: No oversight included; optional purchase of additional oversight available. All unlicensed providers are strongly encouraged to receive oversight from Kale Diagnostics or an outside licensed provider.
  • Labs: All labs must be ordered through KH unless proof of licensure and waiver are provided.

3. Practice and Collaboration:

  • Students can use the CN-P(S) for student designation status until full certification is achieved.
  • Students can only gain full credentials after completing all phases of the program.
  • Students cannot start practicing with the CN-P credential without earning the right.
  • Students are not eligible to solicit collaboration or establish business partnerships with KD team members.
  • Students agree not to form a business relationship with any KH employee, former or current/future.

4. Social Media and Representation:

  • Students must not post on social media or represent themselves as working for KaleĀ Health Professional unless officially employed.
  • Students must not imply any affiliation with KaleĀ Health Professional beyond having received training.
  • Misrepresentation of access and scope of practice with the CN-P credential will be subject to disciplinary action.
  • Students agree not to use KH copy and programs on their site or claim direct affiliation with KH.Ā 

5. Client Communication and Liability:

  • In all client waivers, students must state that KaleĀ Health is not responsible for their independent practice.
  • Students must clearly communicate that Kale Health is not liable in any way for their work with clients.
  • Students release KH from liability for human error.

6. Refund Policy:

  • The program is fully non-refundable.

7. Employment Disclaimer:Ā 

  • KaleĀ Health Professional does not guarantee employment or opportunities for employment for any CN-P Certificate. Work and career opportunities are contingent upon the individual student and not Kale Health.

8. International Students and Foreign Jurisdictions:

  • The CN-P Program is a U.S.-based educational offering designed specifically for U.S. residents.
  • KH, its staff, and the CN-P Program cannot address questions specific to international locations, including legislation, lab ordering, region-specific foods, or accessible supplement companies.
  • It is the sole responsibility of all students, both domestic and international, to understand the laws and regulations in their jurisdiction and how they may practice as a CN-P. Students must act in accordance with their state’s laws and regulations.

9. Practice Disclaimers:

  • Enrollees must independently review and acknowledge the scope and limitations of a nutritionist’s practice in their jurisdiction.
  • KaleĀ HealthĀ Professional does not condone or promote unlicensed or unauthorized medical practice. Enrollees confirm their acceptance and acknowledge their professional responsibilities as defined by their jurisdiction.
  • Enrollees acknowledge that they are unable to request any time with Kourtney herself.
  • General legal information is provided, but no individualized legal advice is shared. KaleĀ Health and the providers within give no advice. KH requires graduates to receive their own legal counsel and encourages them to ask an attorney to approve and review their client agreements which should specifically state that clients should receive approval from a medical doctor (if the student is unlicensed).

10. Code of Conduct:

  • Students must adhere to a code of conduct that includes professional behavior, respect for peers and instructors, and adherence to ethical standards in all interactions and practices.

11. Confidentiality:

  • Students agree to maintain the confidentiality of all case studies, client information, and proprietary information provided by KH.Ā 

12. Intellectual Property:

  • All materials provided in the CN-P Program, including but not limited to written content, videos, and case studies, are the intellectual property of KH and may not be reproduced or distributed without explicit permission.

13. Program Updates:

  • KH reserves the right to modify the program structure, content, and policies as needed. Students will be notified of any significant changes in a timely manner.

14. Dispute Resolution, Liability and Privacy:

  • Any disputes arising out of or related to this Agreement or the CN-P Program shall be resolved through mediation, and if mediation fails, through binding arbitration in accordance with the rules of the American Arbitration Association.
  • Client (student) waives their right to sue or hold liable Kale Health, Kourtney Simmang, and any employees or contractors.
  • Any right to initiate a class action lawsuit is waived.
  • Client understands that any issues that may arise within the professional relationship with CN-P are bound to confidentiality. Clients understand that social media posts involving CN-P must gain approval before being shared. Student agrees to share any concerns or complaints with Kale Diagnostics directly and to discuss in a professional manner, not initiating discussion among fellow students to ensure the peace and privacy of all students enrolled.
  • KaleĀ Health is not responsible for the decisions or actions of CN-P members.Ā 

15. Governing Law:

  • This Agreement shall be governed by and construed in accordance with the laws of the state in which KH is headquartered (Texas), without regard to its conflict of laws principles.

By signing this Agreement, the Student acknowledges and agrees to the terms and conditions outlined above. This Agreement constitutes the entire understanding between KH and the Student concerning the CN-P Program.
